These Terms of Use set out the terms and conditions for use of this MSB Academy Skills (“Website”) and any content, Public Forums, or services offered on or through the Website and/or through any mobile application(s) (“Application”) (collectively referred to as the “Platform”).

These Terms of Use apply to end users of the Website (referred to as “Learners”, “You”, “Your”). These Terms of Use, including the Privacy Policy and any other terms and conditions published on the Platform or communicated to you from time to time (collectively referred to as the “Agreement”), define the relationship and responsibilities between You and Creator (as defined herein) in using the Platform. Your access to the Platform is subject to Your acceptance of this Agreement.

When we speak of “Creator”, “we”, “us”, and “our”, we collectively mean MSB Academy Skills being the creator of this Platform and the content/materials/services contained therein.

By accessing this Platform, You are agreeing to be bound by the terms of this Agreement, all applicable laws and regulations. From time to time, versions of the above-mentioned policies and terms are made available on the Platform for Your reference. By using or visiting the Platform and services provided to You on, from, or through the Platform, You are expressly agreeing to the terms of the Agreement and any other terms that are updated from time to time.

If you disagree with any part of this Agreement or do not wish to be bound by the same, then please do not use the Platform in any manner.

Access and Registration

• You must be at least 18 years of age, or if between 13–18, must have parental or legal guardian’s permission to use the Platform.
• Users under 13 years (or 16 years depending on your country of residence) are not permitted to use or register on the Platform.
• To access Content, you must register with your name and email address. Payment may be required depending on the Content.
• You agree to provide true and complete information at the time of registration and update us of any changes.

Content includes any course or session (live or pre-recorded) published by the Creator, including reference materials and text files.

Learners may also have access to Public Forums to share knowledge with others, though participation is optional.

We reserve the right to deny access or remove content from Public Forums if the Agreement is violated.

You must use a Supported/Compatible Device (computer, mobile, etc.) that meets system requirements. Supported devices may change over time.

License to Use

• You are granted a limited, non-exclusive license for personal, non-commercial use of the Platform’s Content.
• Downloadable Content may be temporarily saved for transitory personal use.

You may not:

• Modify, copy, or create derivative works.
• Publicly display Content for commercial or non-commercial purposes.
• Reverse engineer the Platform.
• Remove copyright notices.
• Transfer or “mirror” materials elsewhere.

This license will terminate automatically if you violate these restrictions. Upon termination, you must delete any downloaded materials.

Communications

• Public Forums are optional to join but must follow the Code of Conduct.
• You are responsible for any content you post (“Learner Content”) and represent that you have rights to use it.
• Unless otherwise indicated in writing, you grant us a worldwide, royalty-free, perpetual license to use, reproduce, modify, and distribute your Learner Content.

Code of Conduct

You agree:

• To use the Platform only for lawful purposes.
• Not to share harmful, violent, hateful, defamatory, or harassing content.
• Not to spam, scam, impersonate, or violate privacy of others.
• Not to disrupt or attempt unauthorized access to the Platform.

Violations may result in suspension, removal of content, or account termination.

Intellectual Property

All materials on the Platform, including Content, Creator Content, software, trademarks, and design, are the Creator’s Intellectual Property.

• You do not acquire ownership rights.
• Unauthorized use, reproduction, or distribution is strictly prohibited.

Feedback

If you submit feedback or suggestions, you grant us perpetual rights to use and incorporate them without compensation.

Payments and Refunds

• Content Fees must be paid via third-party processors.
• Payments may include applicable taxes.
• Once purchased, Content Fees are non-refundable unless otherwise stated in our Refund Policy.
• We do not store sensitive payment information.

Disclaimer

The Platform is provided “AS IS” and “AS AVAILABLE”.

• We disclaim all warranties, express or implied, including merchantability, fitness for a purpose, accuracy, or error-free operation.
• No guarantees are made that the Platform will be uninterrupted, virus-free, or error-free.
• Some jurisdictions do not allow these exclusions, so they may not apply to you.

Limitation of Liability

We are not liable for any damages (loss of data, profits, or interruptions) arising from use or inability to use the Platform.

Indemnity and Release

You agree to indemnify and hold harmless the Creator, its officers, directors, and employees from any claims arising out of Your breach of this Agreement or violation of law/rights of others.

Links to Third-Party Websites

We are not responsible for external sites linked from the Platform. Use of third-party links is at your own risk.

Governing Law and Jurisdiction

Any claims shall be governed by the laws of the Creator’s home jurisdiction, and you agree to the exclusive jurisdiction of its courts.

Miscellaneous

• Alterations: We may update this Agreement at any time.
• Waiver: Failure to enforce any condition does not waive our rights.
• Assignment: You may not assign this Agreement.
• Severability: Invalid provisions will not affect remaining terms.
• Force Majeure: We are not responsible for delays due to events beyond our control.
